General Terms and Conditions of ANNARELLE GmbH
§ 1 Scope of Application
(1) These General Terms and Conditions (AGB) apply to all contracts for the delivery of goods that a consumer (§ 13 BGB (German Civil Code)) concludes with us,

(2) We deliver to the member states of the European Union. Deliveries to countries outside the European Union are made exclusively by prior individual arrangement; please contact us about this (store@annarelle.com).
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.
(4) These terms also apply to orders placed by business customers (§ 14 BGB) who order as end customers. We contractually grant business customers the same rights as consumers: a contractual right to terminate the contract within 14 days under the conditions of the Instructions on Withdrawal, the voluntary 30-day return policy and the guarantee under our Guarantee Terms; statutory warranty rights are not shortened for business customers either. Purchases for the purpose of commercial resale are excluded; we reserve the right to decline orders that are recognizably reseller or bulk orders before acceptance.
§ 2 Formation of the Contract
(1) The product presentations in our online shop do not constitute a legally binding offer but an invitation to place an order.
(2) You can select products from our range and enter the order process via the shopping cart. By clicking the button "Jetzt kaufen" ("Pay now"), you submit a binding offer, with an obligation to pay, to purchase the goods in your shopping cart (§ 312j (3) BGB).
(3) After receipt of your order, you will receive an automatic email in which we confirm receipt of your order (order receipt confirmation). This order receipt confirmation does not yet constitute acceptance of your offer.
(4) The purchase contract is formed when we accept your order by expressly confirming to you by email that we have accepted your order and are processing it (order confirmation), or at the latest upon shipment of the goods. If we do not accept your order within 5 calendar days, you are no longer bound by your order; in that case, we will refund any payments already made without undue delay.
(5) The purchase price becomes due when you complete the order and, depending on the payment method selected, may be charged at that time - including for made-to-order pieces whose delivery takes approximately 4 to 6 weeks. If we do not accept your order or if you withdraw from the contract, we will refund any amounts already paid without undue delay to the payment method originally used.
§ 3 Contract Text, Contract Language, Input Errors
(1) We store the contract text (order data and these terms). You will receive the order data and these terms with the order receipt confirmation by email. You can also view your past orders in your customer account and in the customer portal my.annarelle.com.
(2) The contract language is German. The English version of the shop is provided for information; in case of doubt, the German version prevails.
(3) Before submitting your binding order, you can review your entries on the order summary page and correct them at any time using the usual browser and editing functions (back button, changes in the shopping cart).
§ 4 Prices and Payment
(1) All prices are in euros and include statutory value-added tax. There are no shipping costs (free shipping, § 5).
(2) We accept the following payment methods: American Express, Apple Pay, Google Pay, Klarna, Mastercard, PayPal, Shop Pay, Visa. Details of processing are set out in the order process and in the Privacy Policy.
(3) If you select a third-party payment method (e.g. PayPal, Klarna), that provider's terms of use apply in addition.
(4) Depending on availability, Klarna and PayPal offer financing and installment payment options in the order process. Any financing contract is concluded exclusively between you and the respective provider; the provider decides on availability (including a credit check) and provides the statutory consumer credit information.
§ 5 Delivery and Shipping
(1) Our jewelry pieces are generally made for you only after your order (made-to-order). In that case, the delivery time is approximately 4 to 6 weeks from formation of the contract. Pieces marked as in stock are shipped within 3 to 4 business days. The applicable delivery time is displayed on the product page and in the order process and is thereby agreed.
(2) Shipping is free of charge and insured. We ship with DHL; transport insurance is additionally provided through a specialized goods-in-transit insurer. Deliveries outside Germany may take longer.
(3) The risk of accidental loss and accidental deterioration of the goods passes to you upon handover (§ 446 BGB); for sales involving shipment to consumers, § 475 (2) BGB applies.
(4) If we are in default of delivery, the statutory provisions apply.
§ 6 Retention of Title
The goods remain our property until the purchase price has been paid in full.
§ 7 Right of Withdrawal
Consumers have the statutory right of withdrawal. Details are set out in the Instructions on Withdrawal (separate page, including the model withdrawal form).
§ 8 Voluntary 30-Day Return Policy
In addition to the statutory right of withdrawal, we grant a voluntary return policy of 30 days from receipt of the goods. The conditions are set out in the Instructions on Withdrawal, Part 3; pieces engraved or custom-made on request are excluded there. Your statutory rights remain unaffected.
§ 9 Warranty (Statutory Warranty Rights)
(1) Statutory warranty rights apply (§§ 434 et seq., 437 BGB). The limitation period for warranty claims for new goods is two years from delivery.
(2) Exercising your statutory warranty rights is free of charge for you.
(3) Reports, certificates and images: Our products conform to the characteristics presented in the shop and to the accompanying certificates (e.g. IGI). Minor, production-related variations in handcrafted individual pieces (e.g. minimal variations in stone pattern or surface texture) do not constitute a defect, insofar as they do not affect the agreed characteristics.
(4) Carat specifications: For certified stones (IGI), the carat weight stated in the certificate is decisive - there is no tolerance in this respect. Carat specifications without an individual stone certificate (in particular total carat weights of multiple stones) are marked as approximate; customary, production-related variations within the range stated on the product page form part of the agreed characteristics.
§ 10 Guarantee
For all jewelry pieces, we additionally provide a manufacturer's guarantee of two years covering material and workmanship. The Guarantee Terms (separate page) contain all details. Your statutory warranty rights (§ 9) remain unaffected by the guarantee and are free of charge for you.
§ 11 Liability
(1) We are liable without limitation for damages arising from injury to life, body or health resulting from a breach of duty by us, our legal representatives or vicarious agents, as well as for other damages based on intent or gross negligence.
(2) We are also liable without limitation for damages arising from a breach of a guarantee and for claims under the German Product Liability Act (Produkthaftungsgesetz).
(3) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations - obligations whose fulfillment is a prerequisite for the proper performance of the contract in the first place and on whose observance you may regularly rely), our liability is limited to the damage that is typical for the contract and foreseeable at the time the contract was concluded.
(4) In all other respects, liability for slightly negligent breaches of duty is excluded.
§ 12 Consumer Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG (German Consumer Dispute Resolution Act)).
Implementation note: Do NOT include a link to the EU ODR platform - the platform was discontinued in July 2025; a link would be incorrect today.
§ 13 Governing Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If, as a consumer, you have your habitual residence in another country, the mandatory consumer protection provisions of that country remain unaffected (Art. 6 (2) of the Rome I Regulation).
§ 14 Final Provisions
(1) Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected; the invalid provision is replaced by the statutory provisions.
(2) No place of jurisdiction is agreed with respect to consumers; the statutory rules on jurisdiction apply.
